By using Peak, you accept these terms. They cover what the app does, what it doesn't do, and the limits of our responsibility.

1. Acceptance

By downloading, installing, or using Peak (the "app"), you agree to these Terms of Use. If you do not agree, do not use the app.

2. What Peak Is

Peak is a personal vitality analytics tool. It lets you log a daily morning check-in, sets a goal, tracks streaks, and surfaces patterns from your own self-reported data.

3. What Peak Is Not

Peak is not medical advice. It does not diagnose, treat, or cure any condition.
Peak is not a medical device. The signal levels and insights are personal observations, not clinical measurements.
Peak is not a replacement for a healthcare professional. If you have a medical concern, talk to a doctor.

4. Subscriptions

Peak Pro subscriptions are sold via Apple's App Store. Pricing is shown in the app at the time of purchase. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings (iOS Settings → your name → Subscriptions).

Refunds are handled by Apple. We cannot issue refunds directly.

5. Acceptable Use

You will not reverse-engineer, decompile, or attempt to extract source code from the app.
You will not use the app for any unlawful purpose.
You will not attempt to bypass payment, restore purchases without entitlement, or share your account.

6. Limitation of Liability

Peak is provided "as is" without warranties of any kind. We are not liable for health outcomes, missed insights, biometric inferences being inaccurate, or any consequential damages arising from use of the app. Decisions about your health are your own responsibility.

7. Intellectual Property

Peak, including its name, logo, design, and code, is owned by us. You receive a personal, non-transferable, non-exclusive license to use the app for your own non-commercial purposes.

8. Termination

We may suspend or terminate access to Peak at any time for violations of these terms. You may stop using the app at any time and delete your account by contacting us.

9. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated in-app or via email if you've signed in. Continued use after changes constitutes acceptance.

10. Governing Law

These terms are governed by the laws of the jurisdiction in which our company operates, without regard to conflict-of-law principles.
